Orders & Payment

Shipping & Delivery

We ship within the continental United States (lower 48 states).
Shipping Schedule
Orders ship Monday–Wednesday.
Delivery typically occurs within 1–3 business days.
Customer Responsibilities

Immediately transfer products to a freezer.

We will:
Ship products frozen using insulated packaging.
Include cooling materials (gel packs and/or dry ice when applicable).
Replace items that arrive unusable due to shipping failure.

Cold Packaging & Safety
Shipments may contain dry ice or frozen gel packs.
You acknowledge:
These materials can cause injury if mishandled.
You will keep them away from children and pets.
You will handle them in a safe, ventilated environment.
We are not liable for injuries or damages caused by improper handling of packaging materials.

Blender Use & Safety
Our products may include or be used with portable blenders.
IMPORTANT SAFETY NOTICE
By purchasing or using our blender, you agree to the following:
Do not operate the blender without liquid inside.
Do not blend hot liquids.
Keep hands and objects away from blades.
Do not use a damaged or malfunctioning blender.
Charge and store according to manufacturer guidelines.
User Responsibility
You are responsible for:
Safe operation of the blender.
Proper cleaning and maintenance.
Supervising minors when using the blender.
Blender Liability Waiver
By using the blender, you assume all risks associated with its use. The Athlete's Bakery & Blends LLC is NOT liable for:

Damage caused by overuse, modification, or negligence.
Failure to follow safety instructions.
8.
Subscriptions & Auto-Renewal Disclosure
IMPORTANT: Subscriptions automatically renew. By enrolling, you authorize The Athlete's Bakery & Blends LLC to charge your payment method on a recurring basis at the frequency you selected (e.g., monthly, bi-monthly) until you cancel.
If you enroll in a subscription:
You authorize recurring charges at the then-current subscription rate.
You will receive an email reminder before each charge.
You may cancel or pause anytime before your next billing date — no fees, no questions.
To cancel, log in to your account dashboard or email support@theathletesblender.com at least 48 hours before your next billing date.
Subscription perks (such as 50% off the AB-1 blender and 15% off the first order) are subject to availability and may change.
We reserve the right to modify subscription pricing or structure with advance notice to active subscribers.
Cancellation takes effect at the end of the current billing period. You will not receive a refund for the current billing period.

Returns & Refunds
Due to the nature of frozen food:
All sales are final unless items arrive damaged or unusable.
Claims must be submitted within 24 hours of delivery.
Photo proof may be required.

Limitation of Liability
To the fullest extent permitted by law:
Our total liability is limited to the amount you paid for your order.
We are not liable for indirect, incidental, or consequential damages.
This includes (but is not limited to):
Loss of business or profits.
Personal injury from misuse of products.

Intellectual Property

Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY. It affects your legal rights and requires binding arbitration of most disputes.
Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
Mandatory Informal Resolution
Before initiating any formal dispute process, you agree to:

Allow 30 days for us to attempt informal resolution in good faith.
Participate in a good-faith effort to resolve the dispute informally.
Binding Arbitration Agreement
If informal resolution fails, you and The Athlete's Bakery & Blends LLC agree to resolve any dispute exclusively through binding individual arbitration — not through court litigation or class action — under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules. Specifically:
All disputes arising out of or relating to these Terms, our products, or your use of our services shall be resolved by binding arbitration.
Arbitration will be conducted in Virginia, or via phone/video if both parties agree.
CLASS ACTION WAIVER: You waive your right to participate in any class action lawsuit or class-wide arbitration.
JURY TRIAL WAIVER: You waive your right to a jury trial.
The arbitrator's decision is final and binding, and may be entered as a judgment in any court of competent jurisdiction.
Small claims court matters under $10,000 are exempt from this arbitration requirement.
Exceptions to Arbitration
Either party may seek emergency injunctive relief in a court of law to prevent irreparable harm.
Disputes involving intellectual property rights may be brought in court.
